Draft Draft, to be checked by a lawyer before launch.
Contributor terms.
These terms apply when you add something to Trek Eleven. They sit alongside the Terms of use and the Privacy policy. In the app, you agree to them when you sign in to contribute.
1. What counts as a contribution
A contribution is anything you add to Trek Eleven, including:
- a site check, or a correction to a site;
- an answer to a quick question about a camp;
- a “still like this?” tap;
- a problem report;
- a note or comment;
- a photo;
- your display name;
- feedback about the app.
In these terms, “we” and “us” mean Trek Eleven (see the Terms of use).
2. You keep your rights
You keep ownership of your contribution. These terms do not transfer it to us. They give us a licence to use it, which is described in the next section.
3. The licence you give us
You give Trek Eleven a licence to your contribution. The licence is:
- non-exclusive, so you can still use your own words and photos anywhere else;
- worldwide;
- royalty-free, so we do not pay you for using it;
- perpetual, so it has no end date (but see section 9 for what happens when you delete your account).
Under the licence we may use, copy, store, show, publish, adapt and sublicense your contribution. That includes:
- showing it to other people in the Trek Eleven app and on the website, and in material that promotes Trek Eleven (where we use your photo to promote Trek Eleven, we credit your display name);
- resizing, cropping, compressing and re-formatting photos, and tidying words;
- combining your answers with other people’s to work out what we show (see “How we check” on the website);
- letting the companies that help us run Trek Eleven (for example our hosting provider) store and handle it for us;
- passing the licence on to anyone who takes over Trek Eleven.
The facts that we work out from many people’s answers (for example “Showers: Yes, 3 of 4 people there said so”) belong to Trek Eleven, and so does the way we collect and arrange them.
4. Moral rights
Under Australian copyright law, the author of a work has “moral rights”. These are the right to be named as the author, the right not to be named as the author of something you did not make, and the right not to have your work treated in a way that harms your honour or reputation.
If you are the author of a photo or words that you contribute, you consent, to the extent the law allows, to us and anyone we license doing any of these things, with or without further notice to you:
- showing your contribution without naming you, or naming you only by your display name;
- cropping, resizing, compressing, adjusting, captioning or otherwise editing it for the way it is shown;
- showing it next to other people’s contributions and next to information from other sources;
- using it in the app, on the website, and in material that promotes Trek Eleven (where we use your photo to promote Trek Eleven, we credit your display name).
This consent is for your contribution to Trek Eleven. You give it freely. You do not have to contribute. You can delete your account at any time (see section 9). If you are unsure what this means, email hello@trek11.com.au before you contribute.
5. What you promise
When you add something, you promise that:
- It is yours to share. Your words and photos are your own, or you have the permission of the person who owns them, and you are allowed to give us this licence.
- It is honest. It is true to the best of your knowledge. A check, a correction or an answer comes from your own visit. Do not answer for a place you have not been to, and do not guess.
- You were there when you say you were. Anything marked as “on site” must be from when you were actually at the place. Do not fake your location, and do not use tools that do.
- It is not copied. You have not copied it from another camping app, website, guidebook, review site or database, even in part, and even if reworded. Trek Eleven never copies another app’s data and cannot accept it.
- It is not from OpenStreetMap. Do not paste in information from OpenStreetMap (see section 11).
- It is lawful. It does not break the law, does not infringe anyone’s copyright, privacy or other rights, and is not defamatory, threatening, hateful or abusive.
- It is about the place, not about people. Describe your own experience and the facts of the place: price, cleanliness, access, facilities. Do not accuse anyone of a crime or dishonesty, do not name private individuals, and do not attack owners or staff.
- It is not about your own business. Do not review or answer as a camper about a place you own, run or work at, and do not pay or reward anyone for a review or answer. If you own or run a place, use the owner tools instead (see the Owner terms).
6. Photos
- Add only photos you took yourself, or have the right to share.
- Do not show the face of another person unless you have their OK. Do not show children in a way that could identify them.
- Avoid number plates. If a plate is in your photo, crop or cover it.
- Do not photograph private homes or private areas you were not invited into.
- Photos must not be illegal, indecent or harmful.
- We remove location data from photos before we store them. The app redraws each photo to do this, and our server removes anything left over. If a photo’s location should be shown, it is shown by the site it is added to, not by hidden data in the file.
- We check photos before other people can see them. New photos are seen only by you and by us until we approve them. We may refuse or hide any photo.
7. Points
- You may earn points for contributions. The rules are shown in the app and may change.
- Points are the same whatever you answer, and whether or not you agree with other campers. Points do not come off just because other campers disagree with you.
- You earn points for on-site tasks only if you were really there.
- Points have no cash value and cannot be sold, swapped or transferred. In the test version they may be reset or changed, including at launch.
- We take points off if we remove the contribution that earned them, if we find it was a mistake or cheating, or if we find that you faked your location.
- Daily limits apply to how many of each kind of contribution can earn points.
8. What we do with your contribution
- We work out the facts we show using many people’s answers. Newer answers count more than older ones, answers from people who were at the site count more, and old answers fade. We explain this on the “How we check” page. We keep every answer, with its date.
- A property owner’s answer is labelled “The owner says”. It counts, but it never counts for more than two campers, so campers who were there can outvote it. Owners cannot hide, change or remove what campers add.
- We may check, edit for privacy or clarity (for example to cover a number plate), refuse, hide or remove any contribution. We may suspend or close an account that breaks these terms. We keep a log of changes that our admins make to answers, with the reason.
- We do not promise to publish or keep any contribution.
- We may show your display name next to what you add. Your display name is public.
9. Removing a contribution, and deleting your account
- To remove a contribution, email hello@trek11.com.au and tell us which one. We aim to deal with it within 7 days. If a contribution is wrong, unlawful, or about you, use “Report a problem” or email us.
- You can delete your account in the app: Settings, Account, “Delete my account and data”. You can also first choose “Download my data” to get a copy.
- When you delete your account, we delete your account, your passkeys and sign-in sessions, your checks, reports, taps and notes, your photos (including the files), your feedback notes, your points, and any property listings you added with their photos.
- What stays. Your answers to questions about sites (for example “Showers: yes”, “Dogs: no”, or a fee) stay. We have already combined them with other people’s answers to work out what campers see, and removing them would change those facts for no reason. We cut the link to you: the answer is kept with a random code that matches no one. We cannot tell who gave it, and neither can anyone else. These answers are short choices (yes, no, free, paid and so on). A fee answer can also include the price and how to pay. They carry no photos and no free-text notes.
- The licence in section 3 continues for things we are allowed to keep, such as these anonymised answers. It ends for everything else when we delete it. It does not reach back to copies that other people lawfully made while it was public, and short-term backup copies kept by our hosting provider may take a little while to be overwritten.
10. Problems with a contribution
If you think a contribution infringes your copyright, is defamatory, invades your privacy, or is otherwise unlawful or wrong, email hello@trek11.com.au or use “Report a problem”. Tell us:
- who you are, and how to reach you;
- what the contribution is and where it is shown;
- why it should not be there.
We will look into it, may hide it while we do, and aim to act within 7 days. We will tell you what we decided. If you are a copyright owner, say what you own and how it is infringed.
11. OpenStreetMap and other data
- Trek Eleven shows some places from OpenStreetMap as separate “unverified suggestions”. That data is open data under its own licence (the Open Database Licence).
- We never put your contribution into OpenStreetMap, and we never put OpenStreetMap data into your contribution or into our own checked information. They are kept apart on purpose.
- If a place first appeared in Trek Eleven as an OpenStreetMap suggestion, your answers about it are still your contributions, kept separate from the OpenStreetMap data. Nothing you add to Trek Eleven is released under the Open Database Licence.
- If you want to fix OpenStreetMap, do it at openstreetmap.org, under their terms. Do not copy it into Trek Eleven.
- The same goes for other data we show, such as Main Roads WA and Emergency WA: it is theirs and credited, and it is not yours to change.
12. If your contribution causes us a problem
If you break these terms and that causes us loss (for example, a claim from someone whose copyright you copied), you agree to cover that loss, but only to the extent that it was caused by what you did. This does not take away any right you have under the Australian Consumer Law.
13. Changes, law and contact
- We may change these terms in the way the Terms of use explain.
- The law of Western Australia applies, as set out in the Terms of use.
