Draft Draft, to be checked by a lawyer before launch.

Owner terms.

These terms are for people who list a farm stay on Trek Eleven. A farm stay is a farm, a winery, a station or other private land that its owner lists. You agree to them when you tick the boxes in the “Add your property” form in the app. They sit alongside the Terms of use, the Contributor terms and the Privacy policy.

In these terms, “you” means the person who adds the listing, and the property owner or manager they act for. “We” and “us” mean Trek Eleven (see the Terms of use).

1. Free, with no commission

  • Listing is free. We do not charge you to list, and we take no commission or cut of any booking.
  • If we ever offer something paid, such as a featured spot, it will be optional and clearly labelled. It will never change what campers report, the order campers’ answers count in, or the “last checked” dates. We will not charge you without your clear agreement first.

2. Only if you add it

A farm stay appears on Trek Eleven only because its owner or manager added it. We do not list private properties for you. We do not copy listings from other websites or apps, and you must not either.

3. What you promise

When you list a property, you promise that:

  • You own or manage it. You own the property, or you manage it with the owner’s authority, and you are allowed to list it and to take campers.
  • You hold the approvals it needs. You have every approval you need to have campers stay there. Depending on the property, this can include approval from your shire (local government), planning approval, a camping ground or caravan park licence (or a valid exemption), and compliance with health, fire, building, water and waste rules. You follow those rules.
  • You are insured. You hold the insurance you need to host campers on your land. This usually means public liability insurance. Your ordinary farm or home policy may not cover paying guests, so please check with your insurer.
  • The words and photos are yours to share. You wrote the words and took the photos, or you have the right to use them, and you are allowed to give us the licence in section 8. Photos follow the same rules as in the Contributor terms: no recognisable faces without consent, no number plates where you can avoid it.
  • It is true and kept up to date. What you say about your property (the offer, the facilities, the number of sites, the longest stay, the price, the rules) is accurate. You say so about hazards that campers should know of, such as livestock, dams, steep tracks or fire risk. You keep your listing up to date, and you pause or delete it if you stop hosting or lose an approval.
  • It is lawful. Your listing does not mislead anyone, does not discriminate unlawfully, and does not break the law.
  • Your details are real. Your contact details are correct.

You are responsible for the laws and the shire rules that apply to your property. We cannot tell you what applies to yours. Please check with your shire before you list.

For general information, the WA Government has a page on camping outside caravan parks. It says that up to 5 nights needs the landowner’s approval, and longer stays need the local government’s approval as well. Shires can add their own conditions. It also says WA law generally restricts the use of caravans to licensed caravan parks. Taking paying guests can need more again, such as planning approval or a licence. This is not advice about your property.

4. What we check, and what we do not

  • Before a listing shows to campers, we check that it is complete, that it looks real, and that the code we gave you is on your own website or Facebook page. To check the code on a website, our server may look at your web page once. We may do the Facebook check by hand.
  • We may approve a listing, ask you to change it (we tell you in the app), pause it, or hide it. We may hide a listing straight away if we think there is a safety or legal concern, or after complaints. If we hide it, we show you the reason in the app.
  • When you change a live listing, the change waits for our approval. The earlier approved version keeps showing in the meantime.
  • We do not check that you hold your approvals or insurance, or that your property is safe. We do not inspect properties. Our approval of a listing does not mean we say your stay is lawful, safe or suitable, and it is not advice.

5. How your listing appears to campers

  • Every farm stay carries this line: “Private property. Book with the owner first; never just turn up.”
  • What you say is labelled “The owner says”. Trek Eleven has not visited your property unless the page says so.
  • Your answers about your property (for example facilities, dogs, number of sites) are counted along with campers’ answers. We count your answer as at most two campers on rules and prices, and as one camper on facilities, and never more than two together. Your answer fades with time, so please keep it up to date. Campers who have been there can outvote you. We explain this on the “How we check” page.
  • Campers who stay can add “still like this?” taps, answers, photos and problem reports about your property. You cannot hide, change or remove what campers add. If you think a camper’s contribution is wrong, unlawful or unfair, tell us (see the Terms of use) and we will look at it fairly and aim to act within 7 days.
  • Do not ask campers to remove, change or write a review or answer in exchange for a discount or any benefit, and do not pay for one.
  • Your pin on the map is shown rounded to about 10 metres. Pick a spot that is fine for campers to see, such as the gate or the camping area. It is a business location.
  • Trek Eleven is open in some regions only. A listing outside an open region is saved but not shown until that region opens.

6. Bookings are between you and the camper

  • Campers contact you to book, using the booking link or the phone number you give us (we show a phone number only if you tick that box).
  • Trek Eleven is not part of any booking. We are not your agent, your broker or your booking service. We do not take payments, deposits or cancellations. We do not set your prices or your rules.
  • Everything about a booking, including the price, payment, cancellation, refund, behaviour on your land, and any dispute, is between you and the camper.
  • We do not promise that campers will contact you, turn up, or behave well. We do not promise that your property is as you describe it. You are responsible to campers, including under the Australian Consumer Law.

7. Your private details

The contact name, role and email you give us are private. Campers never see them. We use them only to manage your listing. We say more in the Privacy policy.

8. The licence you give us

You keep ownership of your words and photos. You give Trek Eleven a licence to use them, on the same terms as in the Contributor terms (section 3: non-exclusive, worldwide, royalty-free, perpetual, to use, show, adapt and sublicense). That includes the moral rights consent in section 4 of those terms. In particular, you agree that we may show your words, photos and details in the app and on the website while your listing is live, and in material that promotes Trek Eleven, and may resize and crop photos. When you delete your listing, we remove your words and photos (section 10).

9. If your listing causes us a problem

You agree to cover our loss and reasonable costs if a claim or loss comes from your listing or your property, and was caused by something you did or did not do. For example:

  • the information you gave was wrong or misleading;
  • you did not hold an approval or insurance you promised;
  • the words or photos you gave us infringe someone’s rights;
  • someone is injured, or loses property, on your land.

Trek Eleven is not responsible for what happens on your property. Section 15 of the Terms of use (what we promise, and your rights under Australian law) applies to you too.

10. Editing, pausing, deleting and ending

  • You can edit, pause, resume or delete your listing at any time in the app (Settings, then “Your property”). You can list up to 3 properties on one account.
  • Deleting a listing, or your account, removes the listing, its photos, and the facts about that property, including campers’ answers about it, because nobody is left to stand behind them. See the Privacy policy.
  • We may pause, hide or remove a listing, and close an account, if you break these terms, if the listing is wrong or unsafe, or if the law requires it.
  • If we do, we tell you in the app, with the reason. We do not use email for this, so open the app to check where your listing is up to.

11. Changes, law and contact

  • We may change these terms in the way the Terms of use explain.
  • The law of Western Australia applies, as set out in the Terms of use.
